1、不动产登记请求权问题研究摘要《中华人民共和国物权法》第9条规定：“不动产物权的设立、变更、转让和消灭，经依法登记，发生效力；未经登记，不发生效力，但法律另冇规定的除外。”基于房地产买卖合同而发生的物权变动是目前最为普遍的不动产继受取得方式。而在实际交易过程屮，买卖双方虽签订了交易合同，但未履行登记手续而引发的纠纷时有发生。特别是近几年来，在房地产市场价格波动较大的情况下，买卖双方在履行完成交易合同后，出卖人为了取得更大利益，在尚未完成不动产登记前，解除合同，再卖高价的情况屡见不鲜。我国尚未制订不动产登记法
2、，只有各省市出台的相关房地产登记地方条例。这些条例对登记申请以“共同申请主义"为原则，因此，若出卖人在未完成登记前强行解除合同，买受人的权利则很难得到保障。鉴于基于合同的不动产所有权变更登记是目前最为普遍的物权登记请求类型，故本文以不动产所有权登记请求权为研究对象，从物权登记的法律意义、登记请求权的基本定义入手，提出在我国实行债权形式主义变动模式的前提下，登记请求权虽因合同而产生，却具冇类似物权请求权性质的观点，进而提出了应进一步强化登记请求权的违约责任，完善预告登记制度以及引入其他救济手段等方面的建议。
