1、1.ANewConstitution. Weshouldrecastourpresentconstitution,rescindingitsprovisionsthatcontradicttheprinciplethatsovereigntyresideswiththepeopleandturningitintoadocumentthatgenuinelyguaranteeshumanrights,authorizestheexerciseofpublicpower,andservesasthelegalunderpinningofC

2、hina'sdemocratization.Theconstitutionmustbethehighestlawintheland,beyondviolationbyanyindividual,group,orpoliticalparty.2.Separationofpowers. Weshouldconstructamoderngovernmentinwhichtheseparationoflegislative,judicial,andexecutivepowerisguaranteed.WeneedanAdministrativ

3、eLawthatdefinesthescopeofgovernmentresponsibilityandpreventsabuseofadministrativepower.Governmentshouldberesponsibletotaxpayers.Divisionofpowerbetweenprovincialgovernmentsandthecentralgovernmentshouldadheretotheprinciplethatcentralpowersareonlythosespecificallygrantedby

4、theconstitutionandallotherpowersbelongtothelocalgovernments.3.Legislativedemocracy. Membersoflegislativebodiesatalllevelsshouldbechosenbydirectelection,andlegislativedemocracyshouldobservejustandimpartialprinciples.4.AnIndependentJudiciary. Theruleoflawmustbeabovetheint

5、erestsofanyparticularpoliticalpartyandjudgesmustbeindependent.Weneedtoestablishaconstitutionalsupremecourtandinstituteproceduresforconstitutionalreview.Assoonaspossible,weshouldabolishalloftheCommitteesonPoliticalandLegalAffairsthatnowallowCommunistPartyofficialsatevery

6、leveltodecidepolitically-sensitivecasesinadvanceandoutofcourt.Weshouldstrictlyforbidtheuseofpublicofficesforprivatepurposes.5.PublicControlofPublicServants. Themilitaryshouldbemadeanswerabletothenationalgovernment,nottoapoliticalparty,andshouldbemademoreprofessional.Mil

7、itarypersonnelshouldswearallegiancetotheconstitutionandremainnonpartisan.Politicalpartyorganizationsshallbeprohibitedinthemilitary.Allpublicofficialsincludingpoliceshouldserveasnonpartisans,andthecurrentpracticeoffavoringonepoliticalpartyinthehiringofpublicservantsmuste
