1、浅析我国食品安全的法律保障AnalysisonLegalGuaranteeofFoodSafetyinChina摘要民以食为天，食以洁为安。在全面推进依法治国、建设中国特色社会主义法治体系的今天，提升食品安全法治化水平、建立健全完善的食品安全法律保障体系是法治国家实现食品安全的必由之路。党中央、国务院历来高度重视食品安全工作，多次召开专门会议，强调要严防、严管、严控食品安全风险，确保人民群众“舌尖上的安全”。而我国的食品安全问题积弊已久，历朝历代对此都通过法律手段进行严厉打击，并形成了具有时代特
2、色的立法思想和法律条文，为后世所继承发展。虽然目前食品安全的法律保障体系经过各个时期的发展日益成熟，但尚存在法律可操作性不强、配套法规规章欠缺、法律执行力不足等问题，再加上社会诚信有所缺失、媒体推波助澜等客观原因，我国的食品安全法治仍有部分漏洞，离人民群众的期望值也还有一定距离。若要进一步健全和完善我国食品安全的法律保障，使之更具实效，就应不断提高法律的可操作性、加强其配套法规等制度建设，同时将法治作为保障“健康中国”的最有力武器，倒逼食品安全监管部门履职尽责，提高法律执行力，并强化社会法律监督

6、rovisions.Ithasbeeninheritedanddeveloptbysuccessor.Althoughaftervariousperiodsofdevelopment,thefoodsafetylawguaranteesystemisincreasinglymature,thereisstillproblems,suchasweaklegaloperability,lackofsupportingregulationsregulations, lackoflawexecution
7、andsocialintegrity.Andbecauseofthemediaandotherobjectivereasons,China'sfoodsafetylawstillhavemanyloopholes,andhasacertaindistanceawayfromthepeople'sexpectations.Tofurtherimproveandperfectthelegalprotectionsystemoffoodsafetyinourcountry,tomakeitmoreef
