4、eassociations,publicopinion,orthe“despotismofcustom.”Moreover,weshallignorethemoresubtleusesofstatepower,liketaxation,indoctrination,licensure,andselectivefunding,sothatwemayfocusmorenarrowlyonstatutoryprohibitionsenforcedbypenalsanctions.Whatourquestionhasincommonw

5、ithMill'sbroaderoneisitsemphasisondeterminingthelegitimacyofexercisesofpower.Myreasonforrestrictingtheinquirytothecriminallawispartlymethodological.Evenifonewereconcernedtogiveacompleteaccountofsocialpower,onewouldbeginwiththerelativelybluntandvisibleformsofpolitica
