3、ofSeveranceandTransferQuitclaimDeediThispageisintentionallyleftblank.iiPREFACETOVIRGINIAMODELORDINANCEPERMITTINGTHETRANSFEROFDEVELOPMENTRIGHTSTheVirginiaGeneralAssemblyfirstadoptedstatewideenablinglegislationforlocalzoningordinancespermittingtransfersofdevelopmentrights(“TDRs”)in2006.(Ch.573,20

4、06Va.ActsofAssembly).Thatlegislationwasamendedinthe2007legislativesessiontoallowTDRsacrosscounty-cityboundarieswiththepermissionofthelocalgoverningbodiesandcircuitcourtapproval.(Chs.363and410,2007Va.Acts).Althoughtheoriginallegislationresultedfromanegotiatedagreementbetweenlocalgovernmentorgani

5、zationsandthedevelopmentcommunity,neithersidemovedforwardquicklyafteradoptionoftheenablinglegislationtoimplementTDRprovisionsinanyVirginialocality.Oneidentifiedobstaclewastherequirementintheoriginallegislationthattheseveranceofdevelopmentrightsfromoneparcelandattachmentofthoserightstoanotherpar

6、celoccuratthesametime.InanefforttoremovethatobstacleandmaketheTDRlegislationmoreattractivetolocalitiesanddevelopers,theirrepresentativeshadintermittentdiscussionsovertheensuingtwoyears,eventuallyincludingrepresentativesofrealtors,environmentalpreservationgroupsandothers.Thosetalksledtotheintrod
