2、estandardsettingprocess,preventlawviolation,andpromotefairtradepracticesbypresentingdesirableoperatingschemesthatcanserveasreferenceforbusinessoperatorsparticipatinginstandardsettingandforoperatorsofstandardsettingorganizations.2.BasicCharacteristics1)TheseGuidelinesfocusoncommonandtypicalact

3、sthatmayoccurinthestandardsettingprocess.Inactuality,standardsettingorganizationsmaydeterminehowtheyoperateattheirdiscretioninvariousmanners,takingintoaccounttheirpurposeandcharacteristics;eveniftheyfailtoabidebytheseGuidelines,suchfailuredoesnotnecessarilyconstituteabreachoftheAct.Furthermor

4、e,evenifaspecificactissubjecttotheseGuidelines,itsillegalityshallbedeterminedbasedonwhethersuchactsatisfiesalltheelementsofillegalityundertherelevantprovisionoftheActaftertakingintoaccounttherelevantdetailedfacts.SincethefollowingaremererecommendationstopreventviolationsoftheAct,theyarenotleg

5、allybinding;neitherdotheymeanthatthestandardsettingorganizationshavespecificobligationsincaseofalegaldisputebetweenprivatepersonsinconnectionwithstandardsetting.2)TheseGuidelinesshallnothaveprecedenceovertheGuidelinesforexaminingCartel,GuidelinesforactivitiesofEnterprisers’Organization,Guidel

6、inesforexaminingtheAbuseofDominantPositionintheMarket,GuidelinesforexaminingUnfairTradePractices,GuidelinesforexaminingResalePriceMaintenance,andReviewGuidelinesonUndueExerciseofintellectualpropertyrightsoftheKoreaFairTradeCommission.13.DefinitionsThetermsusedhereinshallbedefinedasfollows:1)"
