3、thirty-fiveyearsago,“isundergoingafundamentaltransformation[whichis]largelythehandiworkoffederaljudges....”[1669].Thistransformationreflectedthecourtsinterventioninregulatorydecisionmakingthrough,amongothertechniques,“hardlookreview”(Leventhal,1974).Thisreview
4、wasdesignedtofacilitatebetterrepresentationbyallaffectedinterests,tocircumscribethenoxiousroleofpolitics–arolelargelycharacterizedasregulatorycapture--andtopromotebetter-reasonedagencydecisions(Edley,1992).Throughaseriesofseminalhardlookcases,includingMotorVeh
5、icleManufacturersAss’nv.StateFarm(1983)andMassachusettsv.EPA(2007)intheU.S.SupremeCourtandkeycasesintheD.C.Circuit,courtsworkedmightilytorescueagenciesfromomnibuspoliticalthreatstogoodgovernanceand,intheprocess,createdanadministrativelawthatreflectedsomething“
6、betterandnoblerthanpolitics”(Shapiro,1986:464).Thisconventionalwisdominthelegalliteratureoncontemporaryadministrativelawiswrong-headedinimportantrespects.Whilethemainstreamofadministrativelawscholarshiphasemphasizedthewaysinwhichcourtsinterposedthemselvesbetwe
7、enthepoliticalbranchesandadministrativeofficialsthroughthedevelopmentofshrewdlegaldoctrines,attentiontothe1dynamicsofregulatorypolicymakingthroughthelensofpositivepoliticaltheoryprovidesadifferentaccount.WithrespecttoCongress,thisdepictionofajudge-ledtransform
8、ationneglectstheimportanttransformations,beginninginthe1960’sandcontinuingoverthenexttwodecades,inAmericannationalpolitics.Duringthisperiod,awiderangeofnewinterestgroupsandconstitu
