4、rorganizationstoStatecompensation(取得国家赔偿的权利)accordingtolaw,andpromotingtheexercisebyStateorgansoftheirfunctionsandpowers(职权)accordingtolaw.Article2(1)WhereStateorgansorStatefunctionaries,inperformingtheirfunctionsandpowers,infringe,inviolationofthelaw,upo
5、nthelawfulrightsandinterestsofthecitizens,legalpersonsandotherorganizations,therebycausingdamageto(造成损害的)them,thevictimsshallhavetherighttoStatecompensationinaccordancewiththisLaw.(2)CompensationbytheStateshallbecarriedoutbytheorgansliableforcompensation(

7、fringingupontherightoftheperson(人身权)ofacitizen:(1)detainingacitizeninviolationofthelaworunlawfullytakingcompulsoryadministrativemeasures(行政强制措施)inrestraintof(限制)hispersonalfreedom;(2)unlawfullytakingacitizenintocustody(非法拘禁)ordeprivinghimofhispersonalfree
8、dombyotherunlawfulmeans;(3)usingsuchviolenceasbeatingoneupormaltreatingsomeone,orinstigatingorgivingloosetootherstousesuchviolence,therebycausingbodilyinjury(身体伤害)ordeathtoacitizen;(4)unlawfullyusingweaponsorpolicer
