1、新兴权利研究——以隔代探望权为例摘要　近几年来，随着公民权利意识的提高，各类新兴权利引起了民众的关注，其中隔代探望权的案件逐渐增多，关于隔代探望权的立法也被广泛讨论。新兴权利的出现给立法环节带来了一定的挑战，同时也为完善法制建设提供了帮助。本文通过文献研究、规范阐释、案例分析三种方法对隔代探望权进行剖析，通过多方面阐述隔代探望权的规范必要性。第一部分先介绍隔代探望权的定义，通过探望权引出隔代探望的含义，对二者进行初步比较；第二部分介绍为什么会出现隔代探望权的纠纷以及隔代探望权的价值和存在的意义，并分析
