2、制度，不足以对民事诉讼中的虚假调解加以规制，民事检察监督的优势明显，民事检察监督的范围，虽然涉及部分民事诉讼虚假调解，然规定本身不够明确具体，如对国家利益、社会公共利益的内涵并未明晰，虚假调解笔录是否是检察监督的对象没有依据，司法机关难以把握，民事虚假诉讼调解检察监督中的调查取证权的落实，缺乏可操作性，需从立法角度对以上的不足予以完善，并扩大民事检察监督介入的进程，以进一步遏制民事诉讼虚假调解。关键词：民事虚假诉讼；民事诉讼虚假调解检察监督；存在问题；完善建议IThestudyofthefalseconciliationcuratorialsupe
