2、对于完善我国民事强制执行制度，保障债权人利益具有十分重要的意义。通过民事间接强制执行制度能够及时化解社会矛盾，维护债权人利益，进而更大限度体现社会公平，提升法律权威。本文从民事间接强制执行制度的理论分析出发，明确民事间接强制执行制度的含义、特点、功能和基本原则，分析我国民事间接强制执行制度的现状和存在的问题，例如没有统一的指导思想、立法分散、威慑性不足以及配套制度不健全等。具体来看，现阶段我国关于民事间接强制执行的规定中，并没有制定单独的法律和相关指导性规则，不仅如此，关于民事间接强制执行制度的概念，尚未得到社会公众的认可，另外，民事间接强制执行制度在具体执行阶段，相关配套手段相对
3、较少。产生这些问题的原因是立法存在滞后性、公民法律意识淡薄、地方保护主义干扰严重以及法院自身工作问题等，在考察国外民事间接强制执行制度后，结合我国法律和社会现实，应当完善我国民事间接执行立法，确立我国的民事间接强制执行指导思想和原则，增强民事间接强制执行的可行性，并完善相关配套制度。关键词：民事诉讼，间接强制执行，代宣誓，财产明示，损害赔偿IABSTRACTABSTRACTThestudyofcivilindirectenforcementsystemisofgreatsignificancetoimproveourcivilenforcementsystemandprotectt
