1、内容摘要存款保险机构在存款保险制度的运行中起着重要作用，负责存款保险制度的决策和执行。存款保险机构职能范围的大小，不仅影响存款保险制度的运作机制和功效的发挥，而且对于存款保险机构与其他金融安全网成员的的职权划分与利益协调具有决定意义。如何定位存款保险机构的职能，是我国存款保险制度构建中的关键性步骤，也是理论界和实务界争论的焦点。本文通过研究和借鉴域外国家或地区存款保险机构职能定位的经验，并结合我国的现实国情，力图对如何定位我国存款保险机构的职能提出立法建议。全文分为引言、正文和结语三部分，正文分为四章：第一

2、章介绍了存款保险机构的界定和分类，并对关于我国存款保险机构职能定位的理论争议进行辨析。第二章通过对美国、日本及我国香港、台湾地区的存款保险机构职能定位进行研究，总结得出对我国存款保险机构职能定位具有借鉴意义的五方面经验。第三章厘清了我国存款保险机构职能定位的目标、原则和银行法律环境的外部约束，力求廓清我国存款保险机构具体职能定位的现实基础。第四章分析了我国对存款保险机构的保险赔付、救助、监管、破产处置与清算四项基本职能的取舍，进而提出存款保险机构具体职能定位的建议。关键词：存款保险机构；职能；定位ABSTR
