1、摘要捅要辩诉交易是检察官与被告人或被告人的辩护律师就被告人是否做出有罪答辩而进行的谈判和交易。辩诉交易的实践首先产生于19世纪的美国，当时美国犯罪剧增、刑事司法资源极度短缺，为缓解资源匮乏的压力，美国部分地区的检察官尝试用交易方式换取被告人的认罪答辩。辩诉交易能够高效快速的解决案件，同时对被告人的回归社会具有重大的意义。本文在阅读大量的国内外文献的基础上，通过运用比较、分析、归纳等方法，系统地阐述了辩诉交易的起源、辩诉交易在世界范围内引入和发展情况、中国式辩诉交易制度的构建等问题。文章分为五个部分：首先，对美国辩诉交易制度进

2、行了详细的介绍；其次，进一步分析了辩诉交易制度在美国之外其他国家的发展和借鉴情况，以阐述辩诉交易制度构建及存在的意义，为辩诉交易制度中国化提供更强的根据；第三，对辩诉交易制度进行了深刻的评析，从正反两方面进行了对比，分别阐述了辩诉交易制度的不足之处和辫诉交易制度存在的价值；第四，论述了我国现实的司法环境和司法改革的前景，系统阐述辩诉交易制度在我国建立的可行性和必要性；最后，以我圜相关立法的现状为出发点，对如何构建中国式辩诉交易制度提出了自己的看法和建议。关键词：辩诉交易；中国化；可行性；必要性IIAbstract——————
