1、中文摘要本文通过介绍不起诉制度、起诉裁量主义在英美法系、大陆法系的历史发展，总结不起诉制度在不同法律文化国家中的类型。探究起诉裁量主义缘何有如此大的魅力，成为刑事诉讼规则中的普世法则。用先进国家的法律视野，阐述不起诉制度在中国刑事诉讼程序中的演变，发展：分为不起诉制度在中国古代历史上的法律文化渊源、新中国建国前后区别对待、分化瓦解的刑事政策、我国现行刑事诉讼法的不起诉规则．蕴藏在该不起诉制度中的深层次价值和司法意义也是值得思考的问题，各种利益冲突的权衡一一符合公共利益原则，目的刑罚的要求、符合刑罚个别化的思想、有利于合理使用司法资源，实现诉讼效率价值，体现刑事程

2、序的安定性都是她的价值所在。随后剖析我国现行不起诉制度的不足之处，显然这样的不起诉制度不符合现代司法理念。本文从扩大检察机关的自由裁量权、建立和解不起诉机制、完善酌定不起诉的适用范围、将不起诉决定同非刑罚措施相结合、建立暂缓起诉制度五个方面，力求描绘出符合我国和谐社会要求、和国际潮流接轨、与我国国情相符相称的不起诉制度。同时将不起诉制度中对检察官自由裁量权的控制规则单独成章，把与检察官公权力相比弱小的被害人、申诉人权益，考虑入权力控制规则，以求实现诉讼方的和谐互动。关键词：起诉裁量主义刑事政策价值自由裁量权酌定不起诉Thisarticleintroducesth
