2、国的客观现实是：由于中国的土地征用补偿制度存在很多缺陷，大量失地农民并没有从土地征用中得到太多的好处，这与农民做出的牺牲贡献很不相称。在城市化进程中，受城市化冲击最直接、最明显的就是那些城市周边的村庄，但由于一系列相关制度、政策的落后，这些村庄却没有完全城市化，而是保留了大量的村庄特征，如：社会经济结构，管理制度和生活方式等，从而形成了城中村。对于城中村的失地农民来说，他们虽然被称作“农民”，但是却失去了土地;虽然有市民的身份，但却没有市民的待遇，没有平等的工作机会，没有基本的养老保险和医疗保险等社会保障措施。虽然城中村失地农民的地理位置相对优越，经济收入相对较高，使他们在很大程度
3、上有别于那些离城市比较远的失地农民，但是他们同样面临生存、就业、年老、疾病等诸多的风险。如何保障失地农民的合法权益、妥善安排他们未来的出路，已成为影响社会稳定和城市化健康发展的首要问题。关键词：城中村；失地农民；养老保险；立法建设VillagesFarmersPensionIssuesAbstractUndertheinfluenceofeconomicglobalization,China'sindustrializationandurbanizationhasenteredaperiodofrapiddevelopment.Withtherapidincreaseofcitie
