1、东南大学硕士学位论文基因隐私权保护中的利益平衡姓名：周蕾申请学位级别：硕士专业：法学；法学理论指导教师：胡朝阳20110307摘要中文摘要当前基因技术的飞速发展为法学研究带来了新的课题。基因隐私权就是在此背景下产生的新的人格权。基因信息作为隐私的一个特殊方面，对基因信息的保护也是一个被法律逐渐认同和认同范围逐步扩大的过程。也由于个人的基因信息是人类的基因身份证明，相比较一般的隐私则更易被侵犯。随着人类基因技术的不断进步，明确人类的基因隐私权并给予保护将不可避免地成为各国法律所要解决的问题。因为代表利益的权利的行使难免会受到与其相对应的义务与伦理道德、社会利益或公共利

2、益的限制，在对基因隐私权所代表的利益进行保护的同时，则必须协调好该种利益与其他各种利益之间的冲突。本文旨在通过对基因隐私权保护中的利益平衡机制的研究而达到科技进步与社会持续发展的目标。本文将从基因信息与基因隐私权的研究出发，结合当下基因隐私权保护中所产生的各种利益冲突现状，对其表现及原因进行详细分析，在对基因隐私权保护及利益平衡制度进行国际立法比较的研究基础上提出构建我国基因隐私权保护中利益平衡制度的一般原则，最后针对当下我国实际生活中有关基因隐私权保护中的利益冲突与平衡问题进行具体的分析。关键词：基因信息，基因隐私权，基因歧视，利益冲突，利益平衡AbstractT
