1、中文摘要随着越来越多的农民涌入城市谋求发展，城市形成了一批又一批的民工潮，由此产生的农民工子女受教育权保障问题得到了社会广泛地关注。本文先从受教育权的概念和内容切入，在此基础上厘清了农民工子女受教育权的内涵。受教育权作为一项基本权利，它的保障和实现离不开国家和社会的义务。我国经过若干年的努力，已经在农民工子女受教育权保障方面取得了一些成效，制定了一些法律、法规，政府出台了各种教育政策，公办学校和打工子弟校接受了许多农民工随迁子女，师资力量和学习条件都有明显提高。然而，现阶段，我国农民工子女受教育权仍然存在一些保障不力的情形，表现为农民工随

2、迁子女入学限制过多、农民工随迁子女升学门槛过高、农民工子女学习条件保障不足。分析原因，主要是由于缺少一部针对农民工子女受教育权的特别保护法、相关民办学校、打工子弟校法律法规不完善、政府职责落实不到位、社区社会组织作用没有得到充分发挥、司法保障不完善。本文提出了完善农民工子女受教育权保障的措施，包括修改立法，制定一部《农民工子女受教育权特别保护法》，推行教育券制度，完善寄宿制，提高教师待遇，鼓励社区社会组织积极发挥作用以及完善司法保障。关键词：农民工子女；受教育权；保障黑龙江大学硕士学位论文AbstractAsmoreandmorefarm
