1、纠纷争执金额高且法律关系牵涉复杂,常见以仲裁方式,即委由第三人做出决定,而对于B2c则主要是以调解的方式来运作,事实处理及调解方式解决争执之问题。从国外运作的经验来看,其效果甚受电子商务Hk者。j消费者的肯定,对于提高电子商务业者的信誉也产生jF面的作用。目前国际问现行之ADR主要是针对B2B与B2C此二者之争端作为主要处理及探讨对象,国际组织对此部份的议题甚为重视,学说及累积实例较多,加以台湾对于建立类似机制较有迫切需要,因此本文主要系以B2B与B2C此两类网络交易所衍生的纠纷、及适用网络争端解决机制的诸项泌题作为研究范围,除广泛搜集、比较主要国家及国际

4、ion,however,hamperedinthedigitalerabyallageoldchallengeforbusiness.Withnouniformlawsorcourtsystemsincyberspace,disappointedconsumersaregropingforwaystoresolveonlineconsumerdisputesthatreflectthespeed,efficiency,andconvenienceofoniinetechnologies。Thereisnowalargebodyofexperiencewit
5、hmanylawyersusingADRasavaluedapproachtOhelptheirbusinessclients.ADRhasprovenitselftosavetimeandmoney,andinmanyinstances,tohelpthepartiestorestoretheirbusinessrelationshipandavoidtheacrimonyofextendedlitigation.OnlineDisputeResolution(ODR)isarelativelynewdevelopmenttailoringalterna
