2、trict,ShenZhencity(utheCompany^),andMr.PassportNo.andhavinghisresidentialaddressat,033BypassRoadBrgy.06AmadeoCavitePhilippines(4119)andhavinghisresidentialaddressUnit1503,XingHuaRoad,HaiChangDongStreet,Shekou,NanshanDistrict,ShenzheninP.R.C.(The"Employee").EachofCompanyandEmployeehereinaftersha

3、llbereferredtoasa“Party'"andcollectivelyas"Parties^.ARTICLE1・GENERALPROVISIONSANDGOVERNINGLAW1.01ThisContractshallbesubjecttoandgovernedbytheLaborLawofthePeople'sRepublicofChinaandotherpublishedandpubliclyavailablelawsandregulationsapplicabletoforeigninvestmententerprisesinShenzhenMunicipality,

4、thePRC・ARTICLE2・TERMOFCONTRACT2.01ThisContractwillbeforatermofone(1)yea匚commencingonOctober20,2009andexpiringonOctober19,2010.2.02ThisContractmayberenewedifbothPartiesagreetotherenewalandsignanewlaborcontractwithinthirty(30)daysbeforetheexpiryofthisContract・Intheabsenceofanewemploymentcontractd

5、ulysignedbybothParties,thisContractshallterminateautomaticallyuponitsexpiration.ARTICLE3・APPOINTMENTANDDUTIES3.01TheEmployeeduringthetermofemploymenthereundershallservetheCompanyinthepositionofLandscapeDesigner/Project/CADManager;andshallperformthedutiesspecifiedbytheCompanyandanyadditionalduti

6、esassignedtohim/herbytheCompanyfromtimetotime.3.02TheCompanyshallhavetherightto,uponagreementbetweentheParties,re-deploytheEmployeetoworkinanothersimilarpositionand/ortovarythedutiesassignedtohim/herbytheCompanybasedonthebusinessrequirementsoftheCompanyandhis/herperformance・3.03TheEmployeeshall

7、devotehis/herfullworkingtimeandattentiontotheperformanceofhis/herduties.Duringthetermofemploymenthereunder,he/sheshallnotbeemployedbyorengagedinanybusinessactivitiesofanyotherentityorpersonwithoutthepriorwrittenconsentoftheCompany
