2、进行的，检察机关在这两种诉讼中很少主动行使检察权。环境诉讼包括了环境民事诉讼、环境刑事诉讼及环境行政诉讼，为更好的实现环境保护，必须不断优化环境诉讼检察能动性，使其在环境诉讼中能主动的行使检察权从而保障环境诉讼的进行。本文在对我国环境诉讼检察能动性认识了解的基础上，针对我国环境诉讼检察能动性中存在的问题对中国环境诉讼检察能动性的优化提出建议，充分发挥检察机关在环境刑事诉讼、环境民事私益诉讼、环境民事公益诉讼中的作用，从而实现对环境的保护。关键词:环境诉讼；检察权；能动性1贵州大学法律硕士学位论文AbstractUnderrapid

4、sticatedlawsuitsassociatedwithenvironmentallitigation,whichhasbecomeacontroversialdebatetopicinacademiccircle.Animportantaspectinthisdomainisprosecutorialinitiativeresearchinenvironmentallitigation.InChina’scurrentprocuratorialpractices,theprocuratorialauthoritylaunch
5、esitssupervisionworkstothecivillitigationandadministrativelitigation,basicallyinaccordancewiththeapplicationprocedures,butrarelyuseitsprocuratorialpowersactivelyinconductingthesetwokindsoflitigation.Environmentallitigationincludestheenvironmentalcivillitigation,crimin
6、allitigationandadministrativelitigation.Toprotecttheenvironmentmoreefficiently,thegovernmentshouldstrengthentheconstructionofprosecutorialinitiativetoenvironmentallawsuits,makingtheprocuratorstotaketheinitiativetoexerciseitsprocuratorialpowerintheenvironmentallitigati
7、onsoastoinsureitseffectivelyproceeding.BasedontheaccurateunderstandingoftheChina’sprocuratorialinitiativeintheenvironmentlitigations,thispaper,inviewofitsexistingproblems,presentsrecommendationstotheprocuratorialinitiativeconstructionandenforcementofprocuratorialautho
