1、摘要工伤认定法律问题是工伤保险法律制度中的必不可少的组成部分，它的内容规定直接涉及到处于弱势地位劳动者的权益保护以及劳资双方的关系稳定。目前，我国相关法律在工伤保险法律制度中的规定还存在问题和局限，本文对我国现有的工伤认定法律问题存在的问题进行系统地分析，通过对工伤保险法律制度的必要性的分析以及对工伤责任承担方式的演变可以看出工伤保险法律制度是保护处于弱势地位的劳动者切身利益的法律保障。在工伤保险法律制度中最重要的一个环节就是工伤认定。在工伤认定中，我国并没有工伤认定一般条款的规定，然而工伤认定的一般条款是认定

2、工伤的法律条件，文章对其他圈家及地区的工伤认定一般条款进行了分析，该规定的合理性是显而易见的。通过对此的分析，期待能对我团立法有所启示。对于工伤认定的标准，各国的觇定也不尽相同，特别是因果要件的理论基础我国也没有明确的规定，这无疑是我国需要解决的问题。最后，工伤认定程序的展开必须由工伤认定机构来组织，程序的运作必须由工伤保险机构来引导。工伤认定机构在工伤保险法律制度的实施过程中起着相当重要的作用，没有工伤认定就不能享受工伤待遇，然而我国工伤认定的程序与机构仍存在很大的问题，这也是我国工伤保险立法所要解决的问题。
