1、摘要自改革开放以来，随着社会主义市场经济的发展，各种类型的经济犯罪层出不穷，涉税犯罪尤其是逃税罪日益增多，严重干扰了正常的社会经济秩序，影响了我国的税收收入。逃税罪是长期以来被我国司法机关列为重点打击的犯罪行为，是我国危害税收征管类犯罪中发案率最高、波及范围最广的犯罪类型。预防和打击逃税犯罪是司法机关在涉税犯罪方面工作的重点，因此，对逃税犯罪定罪量刑标准的研究是具有十分重要意义的工作。逃税罪作为《中华人民共和国刑法修正案（七）》新修改的罪名之一,一定程度上弥补了修改前偷税罪在定罪量刑上的缺陷,但是这次修改还没有从根本上解决一直以来就存在

2、的逃税罪定罪量刑上的问题。基于对逃税犯罪定罪量刑规定的历史沿革、现行逃税罪定罪量刑规定的解读、存在的不完善之处几个方面进行的论述，提出进一步完善的建议,希望能够对我国逃税罪及定罪量刑标准领域相关理论的研究和在实际工作中相关问题的解决有所帮助。关键词：逃税罪，定罪量刑标准，立法缺陷，立法完善I万方数据AbstractSincethereformandopeninguppolicyandthedevelopmentofthesocialistmarketeconomy,varioustypesofeconomiccrimeemergeine
