1、民营企业参与军工生产法律规制的成本收益分析摘要：成本与收益是“经济人”关注的基本问题之一。构建我国民营企业参与军工生产法律规制，作为理性行为者之一－国家的选择，必然涉及成本与收益的分析和比较。论文从这一视角出发，首先分析了构建这一规制的主要成本及其收益构成：成本主要包括规制创立成本、执行成本和风险成本；收益主要包括资源浪费的节约、二部门调整的收益和消费者剩余等。然后进一步地指出了总体成本支付相对较小，但存在支付长期化的倾向，成本是规制数目的函数；总体收益较大，关联效应明显；收益与成本彼此依存、相互转化，成本和收益在某种程度上都是时间的函数
