2、则和各自特点，针对我国采样性检查与人权保障之间的冲突，提出构建采样性检查制度应遵循的基本原则，包括法律保留原则、司法审查原则、比例原则以及救济原则。在具体规范的构建中，笔者依据被采样对象的不同，分别设置对犯罪嫌疑人的采样和对第三人的采样两种不同的程序来规范操作，体现比例原则的运用，期望达到打击犯罪和保障人权二者之间的平衡。关键字：采样性检查；人权保障；立法规制；比例原则作者：张洪指导老师：刘文IAbstractResearchonSamplinginspectioninCriminalInvestigationResearchonSamplinginspectioninCriminal
