1、.论中国文物保护制度的完善摘要文物，从不同侧面反映着各个历史时期人类的生产、生活和环境状况，作为一种以物质形式存在的文化遗产，它是一个国家、民族历史文化的重要载体，它是全人类的共同财富。保护文物不仅是国家的重要职责，也是每个公民应尽的义务。这些年来，我国在文物保护中取得了很大成就，形成了一套较完整的法律体系，但是仍然存在一些尚待解决的问题。本文以文物保护法律为研究对象，采用了法理分析、比较分析等研究方法，从界定文物的范围和概念入手，分析了我国文物保护法律体系建设现状和存在的问题，并提出了可行性建议。第一部分，着重阐述了文物的概念和保护范围，从宪法、法律
2、、行政法规、地方性法规、规范性文件五个层面分析了我国的文物保护法律体系建设现状。第二部分，着重剖析了我国在文物法律建设中存在的问题，从立法、执法、守法三个层面分别进行了阐释。最后，提出了解决和完善我国文物法律保护的几点建议：加快世界遗产和历史文化遗产相关法律立法进度，理顺文物管理体制机制，引导社会公众参与文物保护等等。关键词：文物保护；法律建设；制度；措施...AbstractCulturalrelics,reflectdifferentaspectsofthevarioushistoricalperiodsofhumanproduction,life
