1、中文摘要现代社会，诉权保障是人权保障的逻辑前提。当事人行使诉权不得损害对方当事人利益和案外人利益，否则，构成诉权滥用或恶意诉讼。在我国司法实践中，滥用诉权现象时有发生，甚至愈演愈烈。2013年1月1日实施的新《民事诉讼法》对诉权滥用的打击从诉讼阶段延伸到执行阶段全过程，旨在有效规制诉权滥用行为。但是，新《民事诉讼法》还没有配套的司法解释，在司法实务的操作中还存在模糊性。怎样出台司法解释，如何落实新法对滥用诉权行为的规制，将是立法界和司法界进一步研究的问题。文章以司法实践中滥用诉权的典型案例为基础，具体分析了司法实践中民事诉权滥用的常见类型及形成原因，进而提出了具体的完善建议，以期在司法
