2、自觉践行“德”，最终实现自治。“刑”与“德”意味着两种社会治理模式的对立。秦政的确立代表着法家“刑治”思想的全面胜利。汉承秦制，董仲舒在这样的背景下提出“任德不任刑”，其实是对“刑治”之暴政的“拨乱反正”，具有深刻的时代意义和历史意义。“德刑关系”思想在历史上的制度与实践主要在以下两个方面：一是在国家制度的层面上严法治吏，宽法待民，最大程度地限制国家权力对正常生活秩序的干预，实现以德化培育社会自治力的主张；二是在社会治理的模式中礼乐与政刑并重，实现法律渊源的多层次和治理手段的多元化。关键词：德主刑辅德治德教德刑关系
