1、LABOURLAW(consolidatedtext)(theLawonAmendmentstotheLabourLawpublishedin“OfficialGazetteofMontenegro“,no.59/2011ofDecember14th,2011)IGENERALPROVISIONSSubjectmatteroftheLabourLawArticle1Therightsandobligationsofemployeesarisingfromemployment,themethodandtheprocedureo
2、ftheirexercise,encouragingemploymentandfacilitatingflexibilityinthelabourmarket,shallberegulatedbythisLaw,collectiveagreementandcontractofemployment.ApplicationoftheLawArticle2(1)TheprovisionsofthisLawshallapplytoallpersonsemployedwithanemployerwhoworkintheterritor
3、yofMontenegro,andtoemployeeswhohavebeenassignedtoworkabroadbytheiremployerwiththeheadofficeinMontenegro,unlessotherwiseprescribedbythelaw.(2)TheprovisionsofthisLawshallalsoapplytotheemployeesinstatebodies,publicadministrationauthorities,localgovernmentauthoritiesan
4、dpublicservices,unlessotherwiseprescribedbythelaw.(3)TheprovisionsofthisLawshallalsoapplytoemployeeswhoareforeigncitizensandpersonswithoutcitizenshipwhoworkwithanemployerintheterritoryofMontenegro,unlessotherwiseprescribedbythelaw.Definitionofemploymentrelationship
5、Article3Employmentrelationshipisarelationshipbasedonemploymentbetweenanemployeeandanemployerthatisestablishedbyacontractofemployment,inaccordancewiththelawandcollectiveagreement.Relationbetweenthelaw,collectiveagreementandcontractofemployment79Article4(1)Collective
6、agreementandcontractofemploymentmaynotcontainprovisionsstipulatinglowerrightsorlessfavourabletermsofemploymentthantherightsandconditionsprovidedbythelaw.(2)Collectiveagreementandcontractofemploymentmaystipulatebroaderscopeofrightsandmorefavourabletermsofemploymentt
7、hantherightsandconditionsdefinedbythislaw.(3)Ifcertainprovisionsofcollectiveagreementstipulatenarrowerscopeofrights,orlessfavourabletermsofemploymentthantherightsortermsstipulatedbythelaw,theprovisionsofthelawshallapply.(4)Ifcertainprovisionsofcontractofemployments
8、tipulatenarrowerscopeofrightsorlessfavourabletermsofemploymentthantherightsortermsstipulatedbythelawandcollectiveagreement,theyshallbenullandvoid
