1、ICE/DRODETENTIONSTANDARDLAWLIBRARIESANDLEGALMATERIALI.PURPOSEANDSCOPE.ThisDetentionStandardprotectsdetainees’rightsbyensuringtheiraccesstocourts,counsel,andcomprehensivelegalmaterials.ThisDetentionStandardappliestothefollowingtypesoffacilitieshousingICE/DROdetainees:·ServiceProcessingCenters(

2、SPCs);·ContractDetentionFacilities(CDFs);and·StateorlocalgovernmentfacilitiesusedbyDROthroughIntergovernmentalServiceAgreements(IGSAs)toholddetaineesformorethan72hours.ProceduresinitalicsarespecificallyrequiredforSPCsandCDFs. IGSAsmustconformtotheseproceduresoradopt,adaptorestablishalternativ

3、es,providedtheymeetorexceedtheintentrepresentedbytheseprocedures.SometermsusedinthisdocumentmaybedefinedintheseparateDefinitionsStandard.II.EXPECTEDOUTCOMES.TheexpectedoutcomesofthisDetentionStandardare:1.Detaineeswillhaveregularaccess(nolessthanfivehoursperweek)tolawlibraries,legalmaterialsa

4、ndrelatedmaterials.2.Detaineeswillnotbeforcedtoforgorecreationtimetousethelawlibraryandrequestsforadditionaltimetousethelawlibraryshallbeaccommodatedtotheextentpossible,includingaccommodationsofworkscheduleswhenpracticable,consistentwiththeorderlyandsecureoperationofthefacility.3.Detaineeswil

5、lhaveaccesstocourtsandcounsel.4.Detaineeswillbeabletohaveconfidentialcontactwithattorneysandtheirauthorizedrepresentativesinperson,onthetelephoneandthroughcorrespondence.5.Detaineeswillhaveaccesstoaproperlyequippedlawlibrary,legalmaterialsandequipmenttofacilitatethepreparationofdocumentsaswel

6、lasphotocopyingresources.6.Detaineeswhoareilliterate,non-English-speakingorindigentwillreceiveappropriatespecialassistance.7.Detaineesinspecialmanagementunitswillhaveaccesstolegalmaterialsonthesamebasisasthegeneralpopulation.8.TheapplicablecontentsandproceduresinthisStandardwillbecommunicated
