2、ies.ThisradicaldepartureispartiallyduetoArticle12.AsnotedbytheCommitteeontheRightsoftheChildinGeneralCommentNo.12(2009),Article12isthefirstprovisionofaninternationalhumanrightstreatywhichprovidesthatchildrencapableofformingtheirownviewsmustbeassuredoftherighttofreelyexpressthoseviews(orn
3、ot)inmattersaffectingthatchild,includinginjudicialandadministrativeproceedings,andhavethemdulyweightedaccordingtotheirageandmaturity.ThisrighttobeheardandtakenseriouslyconstitutesafundamentalvalueoftheConventionandhasbeenidentifiedbytheCommittee,alongwithArticles2,3and6,asoneofitsgeneral
4、principles.Thismeansthatinadditiontorecognizingarightinitself,thisarticleshouldbeconsideredintegraltotheinterpretationandimplementationofallotherrightsfoundintheConvention.TheCommitteehasfurthersuggestedthatArticle12establishesanewsocialcontractandimplieslong-termchangeinpolitical,social
5、,institutionalandculturalstructuresandpracticesandissymbolicoftherecognitionofchildrenasrights-holders.Inrecentyears,theterm“participation”hasbecomesynonymouswiththeconceptionofArticle12,whichtogetherwithArticles13and17,isnowwidelyusedtodescribeongoingprocessesofinformation-sharinganddia
6、loguebetweenchildrenandadultsonthedevelopmentofpolicies,programmesandmeasuresrelatedtochildren’slives.ToensurethattheimplementationofArticle12iseffective,ethicalandmeaningful,theGeneralDayofDiscussionontheRightoftheChildtobeHeardrecommendedthatthetermparticipationbebroadlyunderstoodasapr
7、ocessthatistransparentandinformative,voluntary,respectful,relevant,child-friendly,inclusive,supportedbytraining,safeandsensitivetorisk,monitoredandaccountable.WhileArticle12isrecognizedasthefoundationalprovisionrelatedtochildren'sparticipation,theCommitteehasremindedState
