3、dassessedtheimpactofPAEsoninnovationandcompetition,bothpositiveandnegative.Iamsubmittingthiscomment,inmypersonalcapacityanddrawingfrommyownexperience,foronelimitedpurpose–toaddresstheviabilityofaShermanActSection2monopolizationclaimagainstaPAEwhichhasrepudiatedthecommitmentofitsp
4、redecessor(directorindirect),whichparticipatedinastandardsettingorganization(SSO),tolicenseanyofitsintellectualproperty“essential”toastandarddevelopedbythatSSOonfair,reasonableandnon-discriminatory(F/RAND)terms.Thiscommentassumesforpurposesofthisdiscussionthattheever-thornyquesti
5、onofwhatconstitutesabreachofaF/RANDcommitmentcanberesolvedandthatadeterminationofbreachcanbemadeinagivencase.InarecentspeechDeputyAssistantAttorneyGeneralRenataHessediscussedthequestionofSection2antitrustliabilityforpatenthold-upbyownersofstandardessentialpatents(SEPs),whereinthe
