2、risktothehealthandsafetyofanypotentialcustomer.2.ThisEnforcementPolicyStatementsetsoutthegeneralprinciplesandapproachwhichCorbyBoroughCouncilwillfollowwhenconsideringenforcementaction.3.Theappropriateuseofenforcementpowers,includingprosecution,isimportant,bothtosecurecomp
3、liancewiththelawandtoensurethatthosewhohavedutiesunderitmaybeheldtoaccountforfailurestosafeguardfoodsafetyandthepublic’shealth.ThePurposeandMethodofEnforcement4.Enforcementactionwillbebasedonanassessmentoftherisk1topublichealthandnotconstituteapunitiveresponsetominortechn
4、icalcontraventionsofthelegislation.5.TheCouncilwillbeguidedbythestatutoryCodesofPracticeissuedunderSection 40oftheFoodSafetyAct1990,regulation24oftheFoodHygiene(England)Regulations2006,regulation6oftheOfficialFeedandFoodControls(England)Regulations2007,andguidanceproduced
5、bytheLocalAuthoritiesCoordinatorsOfRegulatoryServices(LACORS)andanyguidanceproducedbytheFoodStandardsAgency(FSA).6.Allofficerswhenmakingenforcementdecisionsshallabidebythispolicy.Anydeparturefromthispolicymustbeexceptional,capableofjustification,recordedandapprovedbytheHe
6、althProtectionManager.7.Thepurposeofenforcementisto:·ensurethatdutyholderstakeactiontodealimmediatelywithseriousrisks;·promoteandachievesustainedcompliancewiththelaw;·ensurethatdutyholderswhobreachfoodsafetyrequirementsareheldtoaccount,whichmayincludebringingallegedoffend
