1、摘要lIIIIIIIIIIIIIIIIIIIIY2392346在我国，司法就是人民法院行使审判权的过程，具体说来就是人民法院依照法定的职权和程序，被动适用法律于具体案件的专门活动，任何组织和个人都必须执行，不得擅自修改和违抗。而司法公信力则是人民法院依照法定的职权和程序，被动适用法律于具体案件，并使公众在心理上对其认同和受其约束。司法公信力的结构要素就是司法公信力必须具有的实质、本质以及构成部分。具体包括四个要素，分别是权威、公正、公开、效率。’改革开放以来，人民对司法的认同性越来越高，但是不可否认的是目前司法过程中也存在一些问题，

2、直接导致司法公信力存在缺失。当前我国存在司法公信力程度较低，社会公众对司法的预期与实际效果存在重大差距，司法公信力的提高阻力重重等现状。具体导致司法公信力缺失的原因则是由于历史性原因，体制性原因，司法机关内部原因，文化性原因等多种原因复合而造成的。针对以上问题，如何通过有效的措施重塑司法公信力将是本文研究的重点。司法公信力本质属于意识的范畴，根据马克思主义哲学物质决定意识的理论，构建司法公信力的根本在于发展社会主义生产力。但是也不能否认的是事物之间是普遍联系的，司法公信力的构建是一个系统的工程，应从影响司法公信力的各个方面入手，全面
