1、摘要随着司法体制改革的推进，我国民事执行权的行使经历了从行政司法合作、审执合一、审执分离和独立执行的不断改进过程，但是“执行难"问题不但不见好转反而愈演愈烈，堪称一个困扰着我国民事执行理论界和实务界的世纪难题，以致于得出“执行难"是一道无解的难题这样的无奈结论。执行难的问题不仅使很多当事人的主张只得以确认却得不到执行，而且使法院判决书成为“法律白条"，严重损害了当事人的合法权益，也损害了法院的司法权威。我国法院系统虽然已经采取各种措施与“执行难"顽症斗争了20多年，但因为没有对执行体制进行彻底的规范化和制度化，斗争的结果虽有成

2、效但并不显著。本文在全面分析了执行相关的机制、执行主体、被执行主体以及执行环境等造成执行难的各种原因的基础上，对新修订的《民事诉讼法》中关于执行的内容的改进予以肯定，同时总结我国20年来通过集中清理执行积案、行政领导包案、建立执行联动机制和执行威慑机制等方法对解决“执行难’’进行摸索的过程中的有益经验，提出只有尽快建立完善的《民事强制执行法》，将针对各种造成执行难的原因制定的有效措施加以细化、规范化和权威化，才能从根本上解决“执行难"问题的观点。关键词：执行体制统一执行难民事强制执行法AbstractWiththeadvanc
