1、受贿罪量刑失衡问题研究中文提要受贿罪量刑失衡问题研究中文提要近年来，受贿案件“同案不同判”、量刑不均衡现象引发了社会各界的广泛关注。受贿案件量刑失衡违背公平正义的法律价值目标，妨碍实现预防犯罪的刑罚目的，动摇公众的反腐信心。因此，规范受贿罪的量刑十分必要和迫切。2011年10月1日，最高人民法院全面试行《人民法院量刑指导意见》，对十五个常见罪名的量刑进行了规范。遗憾的是受贿罪未在规范之列。结合这一现状，本文对受贿罪的量刑失衡问题进行专题研究。全文共分为四部分。第一部分，阐述受贿罪量刑失衡的概念、表现及危害。该部分首先界定了受贿罪量刑失衡的定义，并详述了受贿罪量刑失衡的表现及其危害。第二

2、部分，从文化、立法、司法及案外因素等多个角度分析了牵涉受贿罪量刑失衡的十四个因素。第三部分，列举《联合国反腐败公约》、美国和日本对受贿罪定罪量刑的规定，借鉴国际社会对受贿罪定罪量刑的成功经验。第四部分，对我国受贿罪量刑失衡问题解决方案进行了系统思考。该部分针对受贿罪量刑失衡的牵涉因素，借鉴国际社会规范受贿罪量刑的有效方法，从转变刑罚观念、规范完善立法以及推进司法改革三个方面提出了解决我国受贿罪量刑失衡的基本措施与对策。关键词：量刑失衡；受贿罪量刑失衡；牵涉因素；基本对策作者：施爱华指导教师：李晓明教授IAbstractStudyonimbalanceofsentencingdiscre
