7、国近代财产继承权研究的视角看中国过去对财产继承的研究多以男子为对象。而许多世纪以来，男子的财产继承权利甚少变化，这种研究给我们描绘的是一幅静态的图画。一旦我们把研究的焦点转向妇女，一幅关于财产继承权利的大相异趣、动态变化的图画就展现在我们眼前。众所周知，在封建中国，财产继承的规则是众子均分，妇女并无财产继承权。传统继承制度中，宗祧继承决定着财产继承。但当承祧者继承宗祧时，并不发生现代意义上的财产继承，而是通过对全体财产或整个家族的概括承受，发生的仅是家族尊长的人格替代，只有分家之时，现代意义的财产继承才出现。因此，对于男子而言，分家和
