1、武汉科技大学硕士学位论文第1页摘要企业承担社会责任是现代社会演进的内在要求，更是社会主义和谐社会的重要标志。从立法、履行、监督三个方面构建企业社会责任的法律体系对现代社会发展具有重大意义。全文共分为四部分，其具体内容如下：第一部分概述了企业社会责任基本理论。通过对企业社会责任理论的产生与发展、概念与特征及基本内容分析，总结出企业在追求利润最大化之外，还应当关注社会整体利益，即在确保股东利润最大化的同时，应当关心利益相关者的权益，实现社会共赢；第二部分从企业社会责任的法学基础理论着手，重点探讨了企业的权利与义

2、务、企业社会责任与劳动者生存权、企业社会责任与禁止权力滥用原则、企业社会责任与社会秩序几个方面，以期为我国企业社会责任的法律化提供理论支撑；第三部分考察并分析了国内外企业有关社会责任的法律实践，从立法、履行、监督三个方面总结国外在这一问题上的经验和教训，并通过对比分析，研究了我国企业社会责任的法律问题，分析了我国企业承担社会责任方面的不足及缺陷；第四部分通过对以上三个部分的总结与思考，提出了“如何完善我国企业社会责任法律法规及其相关措施”的～些新构想，建议完善有关企业社会责任的立法及相关措施，希望能够对我国
