1、先原则、法律保留原则。在此基础上，笔者提出通过健全自治章程制定程序、完备内部运作程序、建立内部监督救济程序来进行事前、事中、事后规制，进而完善我国行业协会自治权的程序规制。第四部分对行业协会自治权的责任追究机制进行了细致阐述。行业协会自治权的责任追究机制主要有两种，一种是内部追究机制，即通过行业协会内部的听证、复核、申诉等制度进行责任追究；另一种是外部追究机制，笔者提出适度引入司法审查来对行业协会自治权进行责任追究，在对其进行司法审查时，应保持谨慎而谦抑的态度，合理限定审查范围和强度，防止司法过度干预影响行业协会的自治品格。关键词：行业协会；自治权；程序规制
