1、无偿担保论文：我国担保行业监管制度研究【中文摘要】我国信用担保行业的迅速发展,为改善我国中小企业融资环境、扶持中小企业发展发挥了举足轻重的作用,信用担保业已成为我国金融体系的组成部分。然而担保业作为一个新兴行业,还存在着担保机构规模较小、风险分散机制和补偿机制缺失、担保品种单一、担保机构运作不规范、监管制度不健全等一系列问题。这些问题尤其是我国目前对担保业监管制度的不健全严重制约着担保业的持久发展。本文着眼于我国担保业的可持续发展,对我国担保业监管制度的健全与完善进行了论述。第一部分介绍了我国担保业的历史沿革、发展现状以及目前我国担保业存在的问题,以及我国目前担保业监管制度的不
2、足之处,论述了加强我国担保业监管制度的必要性。第二部分论述了担保业监管的基础理论,介绍了无偿担保与有偿担保、政策性担保与商业性担保的概念、联系与区别,以及担保业的性质与地位、组织与运营、风险与防范、自律与监管、意义与作用。第三部分介绍了当前国外对担保业监管的两种模式,即以美国为代表的西方模式及以日本、韩国为代表的东亚模式,并对美国、日本、韩国等国家比较完备的担保监管体系进行比较分析。第四部分论述了我国担保监管制度的健全与完善。该部分从明确监管主体、监管职责、发挥行业自律、规范政府行为、完善相关法律制度等五个方面论述了我国担保监管制度的完善。【英文摘要】Thefastdevelo
