1、摘要现行土地征收补偿制度是计划经济时代的产物，在市场化改革与发展的今天，其与土地的资源性特征、集体土地所承担的功能和开发利用的现状明显不符。制度的滞后不仅使农民及农民集体的合法权益无法保障，与此相关的土地征收制度更是成了我国当前经济社会持续发展的制度障碍。因此对现行土地征收补偿制度进行理性分析，在制度上对之进行合理的构建是必要的，在建设统筹发展与法治社会的今天也是可行的。文章在对土地征收补偿制度的法源基础和域外征地补偿制度进行考量后，根据我国的国情，指出完善我国土地征收补偿制度的两个基本价值目标——维护土地征收的可持续性和促进土地征收中的城

2、乡统筹发展。在此基础上就如何完善集体土地所有权主体制度，确立土地征收的合理补偿原则，建立科学、公正、合理的收益分配制度和建立健全征地补偿的救济制度等法律问题展开论述，以求有益于土地征收法制建设与征地实务的完善。关键词：土地征收；补偿制度；法学研究5ABSTRACTThepresentsystemsofexpropriationoflandsandcompensationforpeasantsaretheoutcomeoftheAgeofthePlannedEconomy,andtheyareobviouslynotcorrespondingw

4、santsbecometheobstacletocontinuallydeveloptheeconomyandsocietyinourcountry.Soitisnecessarytoanalyzerationallythepresentsystemsandtoconstructreasonablynewsystemsbasedontheoldones,anditisalsofeasibletodosointhesituationsofconstructionanddevelopmentasawhole.Afteranalyzingtheba

5、seofthesourceoflawofthesystemsandtheoverseassystems,accordingtothesituationsinourcountry,thewritersetuptwobasicvalueaimsforimprovingthesystemsofexpropriationoflandandcompensationforpeasants.Thesetwobasicaimsaretomaintainthecontinuityoftheexpropriationoflandandtoaccelerateth

6、edevelopmentofcityandcountryasawholeintheprocessofexpropriatingland.Thenthelegalproblemsthathowtoimprovethesystemsofmainbodyofownershipofcollectiveland,tosetupthereasonableprincipleofcompensationintheexpropriationofland,tobuildscientificandfairsystemsofdistributionofprofits
