1、我国刑事诉讼中秘密侦查制度化研究摘要：我国1993年颁布的《国家安全法》、1995年颁布的《人民警察法》、1989年最高人民检察院、公安部《关于公安机关协助人民检察院对重大经济案件使用技侦手段有关问题的答复》以及我国2012年新修订的《刑事诉讼法》把相继秘密侦查纳入了立法规范的范围。但是我国关于秘密侦查的立法规定还停留在初级层面，并没有对秘密侦查的实施主体、适用范围、适用程序、权利保障等关键问题进行详细规定，这就无法充分有效打击刑事犯罪，保障公民的合法权益。本文试着借我国正在进行的借监察体制改革之机，结合当前法学界对秘密侦查的研究结果，分析秘密侦查在

2、我国立法的困境和不足，吸收国外先进的秘密侦查的法律规定和实践经验，从以下几个方面进一步完善我国秘密侦查：一是重新明确秘密侦查权的实施主体，二是严格限制秘密侦查的适用范围；三是规范秘密侦查所收集证据的使用；四是是确立违反秘密侦查的救济程序，赋予被侦查对象以及辩护人知情权、异议权、使用权以及获得赔偿权等；五是对秘密侦查建立有效的监督。关键词：刑事诉讼；秘密侦查；侦查手段；人权保障TheResearchontheSystemofSecretInvestigationinCriminalProcedureinChinaAbstract:In1993China
