1、中文摘要当前，我国侦诉关系在“分工负责，互相配合，互相制约”的原则下的监督与被监督关系，在刑事诉讼模式特别是庭审方式发生重大变化的条件下，实践中的弊端越发明显。表现在检察机关对侦查活动的实际控制力相对较弱，审查程序的连贯性不足，流畅性受阻，侦查人员的司法理念滞后，证据意识不强，影响了公诉的指控力度和法律效果。本文首先对侦诉关系的形成及基本原理和确立原则进行了阐述，在此基础上，运用比较的方法介绍了当今世界关于侦诉关系几种主要类型及其有代表性的国家，继而分析了侦诉关系在世界范围内的发展趋势。其次又针对我国现行法律框架内

2、的侦诉关系状况进行了利弊分析，从而得出了需要改造的结论。最后，从我国实际出发结合世界侦诉关系的发展趋势，有针对性地提出了在保留既有框架的基础上完善我国侦诉关系的建议。因为侦诉关系的调整与重构涉及到执法理念的更新，组织结构的调整等多种因素，采用渐进式、改良性方法更具有实效性，以期能够对我国的侦诉关系的完善有所裨益。关键词：刑事诉讼侦诉关系重构监督制约中图分类号：D915．1AbstractTherelationshipbetweeninvestigativeandproseeutorialsystemhasbeeng
