2、sereasonableskillintheperformanceofthecontract; (b)ofanycommonlawdutytotakereasonablecareorexercisereasonableskill(butnotanystricterduty); (c)ofthecommondutyofcareimposedbytheOccupiers’LiabilityAct1957ortheOccupiers’LiabilityAct(NorthernIreland)1957. (2)ThisP

3、artofthisActissubjecttoPartIII;andinrelationtocontracts,theoperationofsections2to4and7issubjecttotheexceptionsmadebySchedule1. (3)Inthecaseofbothcontractandtort,sections2to7apply(exceptwherethecontraryisstatedinsection6(4))onlytobusinessliability,thatisliabil

4、ityforbreachofobligationsordutiesarising— (a)fromthingsdoneortobedonebyapersoninthecourseofabusiness(whetherhisownbusinessoranother’s);or (b)fromtheoccupationofpremisesusedforbusinesspurposesoftheoccupier;  andreferencestoliabilityaretobereadaccordinglybutlia

5、bilityofanoccupierofpremisesforbreachofanobligationordutytowardsapersonobtainingaccesstothepremisesforrecreationaloreducationalpurposes,beingliabilityforlossordamagesufferedbyreasonofthedangerousstateofthepremises,isnotabusinessliabilityoftheoccupierunlessgra

6、ntingthatpersonsuchaccessforthepurposesconcernedfallswithinthebusinesspurposesoftheoccupier. (4)Inrelationtoanybreachofdutyorobligation,itisimmaterialforanypurposeofthisPartofthisActwhetherthebreachwasinadvertentorintentional,orwhetherliabilityforitarisesdire

7、ctlyorvicariously. 2Negligenceliability (1)Apersoncannotbyreferencetoanycontracttermortoanoticegiventopersonsgenerallyortoparticularpersonsexcludeorrestricthisliabilityfordeathorpersonalinjuryresultingfromnegligence. (2)Inthecaseofotherlossordamage,apersoncan
