1、UnfairContractTermsAct1977  PartI AmendmentofLawforEnglandandWalesandNorthernIreland  1ScopeofPartI (1)ForthepurposesofthisPartofthisAct,“negligence”meansthebreach— (a)ofanyobligation,arisingfromtheexpressorimpliedtermsofacontract,totakereasonablecareorexercisereasonableskillintheperformanceo

2、fthecontract; (b)ofanycommonlawdutytotakereasonablecareorexercisereasonableskill(butnotanystricterduty); (c)ofthecommondutyofcareimposedbytheOccupiers’LiabilityAct1957ortheOccupiers’LiabilityAct(NorthernIreland)1957. (2)ThisPartofthisActissubjecttoPartIII;andinrelationtocontracts,theoperation

3、ofsections2to4and7issubjecttotheexceptionsmadebySchedule1. (3)Inthecaseofbothcontractandtort,sections2to7apply(exceptwherethecontraryisstatedinsection6(4))onlytobusinessliability,thatisliabilityforbreachofobligationsordutiesarising— (a)fromthingsdoneortobedonebyapersoninthecourseofabusiness(w

4、hetherhisownbusinessoranother’s);or (b)fromtheoccupationofpremisesusedforbusinesspurposesoftheoccupier;  andreferencestoliabilityaretobereadaccordinglybutliabilityofanoccupierofpremisesforbreachofanobligationordutytowardsapersonobtainingaccesstothepremisesforrecreationaloreducationalpurposes,

5、beingliabilityforlossordamagesufferedbyreasonofthedangerousstateofthepremises,isnotabusinessliabilityoftheoccupierunlessgrantingthatpersonsuchaccessforthepurposesconcernedfallswithinthebusinesspurposesoftheoccupier. (4)Inrelationtoanybreachofdutyorobligation,itisimmaterialforanypurposeofthisP

6、artofthisActwhetherthebreachwasinadvertentorintentional,orwhetherliabilityforitarisesdirectlyorvicariously. 2Negligenceliability (1)Apersoncannotbyreferencetoanycontracttermortoanoticegiventopersonsgenerallyortoparticularpersonsexcludeorrestricthisliabilityfordeathorpersonalinjuryresultingfro

7、mnegligence. (2)Inthecaseofotherlossordamage,apersoncannotsoexcludeorrestricthisliabilityfornegligenceexceptinsofarasthetermornoticesatisfiestherequirementofreasonableness. (3)Whereacontracttermornoticepurportstoexcludeorrestrictliabilityforn
