1、南京航天航空大学硕士学位论文摘要公益诉讼是为维护国家与社会公共利益而提起的一种诉讼形式。它是工业革命以来世界各国经济与科技飞速发展，社会化程度不断加大，导致社会公共问题日益突出的产物；是司法上为适应社会经济变革而创设的一种新型诉讼制度。在当前发展我国社会主义市场经济的新时期，借鉴国外经验，适时建立符合我国实际的公益诉讼制度，不仅是顺应世界立法发展趋势，进一步完善我国法律体系的需要；还是更好地遏制社会转型期忽视和危害公共利益现象愈演愈烈的有效方法之一；同时，更是进一步贯彻依法治国的基本国策，充分实现人民主权的要求。本文研究的目的在于探讨在我国建立公益诉讼制度的
2、有关理论与实践问题。以期为合理建立这一制度提供一些支持和有益的参考。从此点出发，运用马克思主义历史与辩证的分析方法，首先考察了公益诉讼的概念及其在国外的发展状况，其次对公益诉讼的理论基础及其在我国建立该制度的必要性和可行性进行分析，为建立这一制度提供坚实依据。然后，立足于对我国传统诉讼制度的继承与改造，并适当参照国外经验，探讨了建立我国公益诉讼制度的路径、方法与具体制度设计，力图对建立这一制度的实践问题提出自己的见解。关键词：公共利益,公益诉讼,当事人理论,行政前置,原告范围,受案范围,举证责任i建立我国公益诉讼制度问题研究ABSTRACTPublicint
