1、AbstractItisknowntoallthattheactivityoftranslationisdifficult.However,amongthosetypesoftranslation,legaltranslationisprobablyregardedasoneofthemajordifficulties,whichislargelyreflectedinthetranslationoflegalterms.Thathowtoconveythemeaningoflegaltermsinthesourcelanguagesystempreciselyisabigproblem
2、yettobesolvedinthefieldoflegaltranslation.Besides,seekingequivalenceinthelegaltermsisviewedasoneofthehotconcernsoflegaltranslators.Amongtremendousamountsoftranslationtheories,“functionalequivalence”isdeemedasoneofthemostefficienttranslationtheoriesforthetranslationoflegalterms.Inconsiderationofth
3、esignificantguidanceoffunctionalequivalenceonlegaltranslation,basedonthistheoreticalframework,andbyselectingthetranslationsofmajorlegaltermsinthethreeEnglishversionsoftheGeneralCivilLawActofthePRC(issuedin1986)assourcematerials,thisthesismakesasystematicalcontrastiveanalysisoflegaltermsandtheirEn
4、glishexpressionsinthetranslationsfromthefollowingaspects.Firstly,withthecontrastiveresearchesonbothmeaningandformoflegalterms,thisthesisconcludesthatitisbettertoresorttosometranslationprinciplesintheprocessoflegaltranslatinginordertorealizeequivalenttranslations,especiallyforthetranslationoflegal
5、terms.Secondly,thisthesismakessomeadjustmentsofthetheorytosuitspecialcharacteristicsofthetranslationoflegalterms,andsummarizessomeprinciplessuchasthepriorityofcontextualconsistencyisoververbalconsistency,functionalequivalenceoverformalequivalence,thewrittenformovertheheardform,andtheformsoflangua
6、geovertheneedsofaudience.Lastly,thethesistentativelyproposessomespecialprinciplesforthetranslationoflegaltermsfromtheaspectsofprofessional,consistency,accuracyandequivalence.Asfarasthisthesisisconcerned,legaltranslatorshavetoenrichthemselveswithprofessionalknowledgefirstandthenprobeintolegaltrans
7、lation,whileduringtheprocessoftranslating,theyshallbothtransferthemeaningpreciselyandunifymeaningandbackgroundlegalculture,andeventuallyrealizetheclosetequivalenceofthesourcetextsandthetranslatedtexts.Insum,whencombine
