4、ationviolationPenaltiesforallmedicationanddrugviolationsshallbeinvestigatedandreviewedonacasebycasebasis.Extenuatingfactorsinclude,butarenotlimitedto:(1)Thepastrecordofthetrainer,veterinarianandownerindrugcases;(2)Thepotentialofthedrug(s)toinfluencea

5、horse’sracingperformance;(3)Thelegalavailabilityofthedrug;(4)Whetherthereisreasontobelievetheresponsiblepartyknewoftheadministrationofthedrugorintentionallyadministeredthedrug;(5)Thestepstakenbythetrainertosafeguardthehorse;(6)Theprobabilityofenviron

6、mentalcontaminationorinadvertentexposureduetohumandruguse;(7)Thepurseoftherace;(8)WhetherthedrugfoundwasoneforwhichthehorsewasreceivingatreatmentasdeterminedbytheMedicationReportForm;(9)Whethertherewasanysuspiciousbettingpatternintherace,and;(10)Whet

7、herthelicensedtrainerwasactingundertheadviceofalicensedveterinarian.Asaresultoftheinvestigation,theremaybemitigatingcircumstancesforwhichalesserornopenaltyisappropriateforthelicenseeandaggravatingfactors,whichmayincreasethepenaltybeyondtheminimum.A.U
