2、oagreedasfollows:PARTI.GENERALPROVISIONSArticle1.DefinitionsInthisConvention:1."Carrier"meansanypersonbywhomorinwhosenameacontractofcarriageofgoodsbyseahasbeenconcludedwithashipper.2."Actualcarrier"meansanypersontowhomtheperformanceofthecarriageofthegoods,orofpartofthecarriage,hasbeenent

3、rustedbythecarrier,andincludesanyotherpersontowhomsuchperformancehasbeenentrusted.3."Shipper"meansanypersonbywhomorinwhosenameoronwhosebehalfacontractofcarriageofgoodsbyseahasbeenconcludedwithacarrier,oranypersonbywhomorinwhosenameoronwhosebehalfthegoodsareactuallydeliveredtothecarrierin

4、relationtothecontractofcarriagebysea.4."Consignee"meansthepersonentitledtotakedeliveryofthegoods.5."Goods"includesliveanimals;wherethegoodsareconsolidatedinacontainer,palletorsimilararticleoftransportorwheretheyarepacked,goodsincludessucharticleoftransportorpackagingifsuppliedbytheshippe

5、r.6."Contractofcarriagebysea"meansanycontractwherebythecarrierundertakesagainstpaymentoffreighttocarrygoodsbyseafromoneporttoanother;however,acontractwhichinvolvescarriagebyseaandalsocarriagebysomeothermeansisdeemedtobeacontractofcarriagebyseaforthepurposesofthisConventiononlyinsofarasit

6、relatestothecarriagebysea.7."Billoflading"meansadocumentwhichevidencesacontractofcarriagebyseaandthetakingoverorloadingofthegoodsbythecarrier,andbywhichthecarrierundertakestodeliverthegoodsagainstsurrenderofthedocument.Aprovisioninthedocumentthatthegoodsaretobedeliveredtotheorderofanamed
