2、naThemeasuresfortheadministrationofcommodityhouseleasehavebeenexaminedandapprovedbythetwelfthexecutivemeeting,whichisherebypromulgatedandshallcomeintoeffectonFebruary1,2011.MinisterofhousingandurbanruraldevelopmentJiangWeixinDecember1,2010Measuresfortheadministrationofleaseofcommodityhouse

3、sThefirstistostrengthenthemanagementofcommodityhouseleases,standardizethecommodityhousingrental,maintenancehousingleaselegitimaterightsandinterestsoftheparties,accordingtothe"People'sRepublicofChinaCityrealestatemanagementlaw"andotherrelevantlawsandregulations,theenactmentofthisapproach.Th

4、eseMeasuresshallapplytotheleaseofcommodityhousesonthestate-ownedlandwithinthesecondurbanplanningzones(hereinafterreferredtoastheleaseofhouses)andtheirsupervisionandadministration.Theleaseofthethirdhousesshallfollowtheprincipleofequality,voluntariness,legalityandgoodfaith.Fourth,theStateCou

5、ncilHousingandurbanconstructiondepartmentsresponsibleforthenationalhousingrentalguidanceandsupervision.Thelocalpeople'sgovernmentatorabovethecountylevelshallberesponsibleforthesupervisionandadministrationofHousingleasinginitsadministrativeareas.Fifthofthepeople'sGovernmentofmunicipalities,

6、cityandcountybuilding(realestate)administrativedepartmentsshouldstrengthenrentalregulationsandtheuseofhousingsafetyknowledgepropaganda,regularlypublishedregionaldifferenttypesofhousingmarketrentsandotherinformation.Sixthhousesunderanyofthefollowingcircumstancesshallnotbeleased:(1)ofillegal

7、construction;(two)failingtomeetthemandatorystandardsfortheconstructionofsuchprojectsassafetyanddisasterprevention;(three)changingthenatureoftheuseofhousesinviolationoftheregulations;(four)othercircumstancesprohibitedbylawsandregulations.Seventhhousingrentalpar
