1、摘要：鸦片战争之后，国内外局势和中外关系发生剧变，中国相沿已久的涉外经济法律制度被彻底打破，在外来势力的胁迫、参与、干预下，晚清涉外经济法律制度逐步构建，肇始于第一次鸦片战争之后的和谈，第二次鸦片战争之后基本定型，甲午战争之后渐趋成熟，基本内容被南京临时政府和北洋政府沿袭。在曲折中构建、发展的晚清涉外经济法律制度烙有鲜明的时代特色，透射出中国社会在近代转型中的无奈与抗争，冲击与反应。 关键词：晚清；涉外经济法律制度；影响 鸦片战争以前，从立法、执法到司法的整个过程，中国政府对来华外商都拥有完全的自主权。但是，鸦片战争以后，国内外局势和中外关系发生巨变，中国被迫在各个方面作
